What this bill would do
This bill is known as the Hong Konger Promise of Refuge Act. It allows certain permanent residents of Hong Kong who were granted Deferred Enforced Departure to adjust their status to lawful permanent residents. To qualify, individuals must meet specific conditions, such as continuously residing in the United States since January 15, 2025, and not being convicted of certain crimes. Spouses, children, and unmarried adult sons and daughters of qualifying individuals are also eligible for status adjustment. Applicants are protected from immigration detention and removal and are given work authorization while their application is pending. Finally, the bill cancels any prior removal orders for individuals whose status is adjusted.

Potential Positive Impacts for People
-
Under Section 2(a) and Section 2(b), certain permanent residents of Hong Kong who were granted Deferred Enforced Departure can apply to become lawful permanent residents, provided they meet conditions like continuous residence since January 15, 2025, and having no felony or two misdemeanor convictions. This gives these individuals a path to permanent legal status in the United States.
-
Under Section 2(c), the spouse, children, and unmarried adult sons and daughters of a qualifying individual are also eligible to adjust to lawful permanent resident status. This keeps families together in the United States.
-
Under Section 2(e), an alien who submits an application for adjustment of status is protected from immigration detention, removal, or removal proceedings while the application is pending, and is authorized to engage in employment. This allows applicants to work and live without the immediate fear of removal during the application process.
-
Under Section 2(f), if an alien's status is adjusted to a lawful permanent resident, any prior removal orders to which they were subject are cancelled. This clears past removal threats for qualifying individuals.
