What this bill would do
This bill is called the Revising SSDI Disability Classifications Act and it directs the Commissioner of Social Security to carry out a 10-year demonstration project. The project will test a new system for classifying individuals who receive Social Security disability insurance benefits based on the chronicity and expected improvement of their impairments. It also temporarily extends the reauthorization of demonstration project authority through December 31, 2036, and sets final report deadlines for December 31, 2037. Under the project, individuals will be placed into four specific categories with different schedules for continuing disability reviews. The bill limits appeals of these classifications strictly to requests for administrative reconsideration to correct factual errors like clerical mistakes. Finally, the Commissioner must submit reports to Congress evaluating the project's effects on program integrity, employment outcomes, and administrative efficiency.

Potential Positive Impacts for People
-
Section 3, adding Section 234(g)(2)(A)(i) to the Social Security Act: This provision establishes a system that classifies individuals into specific categories based on whether their impairments are chronic with irreversible loss, or whether medical improvement is expected within various timeframes. This might be considered positive because it tailors continuing disability reviews to the specific medical expectations of the individual's condition.
-
Section 3, adding Section 234(g)(2)(A)(ii) to the Social Security Act: This provision sets specific, varied timelines for conducting reviews to determine whether an individual remains under a disability, ranging from the 2nd year for those expected to improve quickly up to the 7th or 8th year for those with chronic conditions. This might be considered positive because individuals with permanent, irreversible conditions will not face frequent continuing disability reviews.
-
Section 3, adding Section 234(g)(2)(C) to the Social Security Act: This provision allows participants selected for the demonstration project the opportunity to decline participation. This might be considered positive because it gives individuals a choice in whether they want to take part in the project.
Potential Negative Impacts for People
- Section 3, adding Section 234(g)(2)(B)(ii)(I) to the Social Security Act: This provision states that, except for factual errors, there shall be no review of, or right to appeal, a classification made under the system. This might be considered negative because participants who disagree with their assigned disability classification category are explicitly denied the right to appeal it.
