What this bill would do
This bill is known as the Clarifying Law Around Insurance of Marijuana Act or the CLAIM Act. It prevents Federal agencies from penalizing, discouraging, or limiting insurers that provide insurance to legitimate cannabis-related businesses. The bill also protects these insurers, along with their officers, directors, and employees, from being held liable under any Federal law solely for providing insurance or investing income from those insurance activities. Additionally, the legislation requires the Comptroller General to conduct a study on the barriers to marketplace entry and access to financial services for minority-owned and women-owned cannabis-related businesses. Finally, the bill clarifies that insurers are not required to offer insurance to cannabis businesses.

Potential Positive Impacts for People
-
Protection for Insurers and Workers: Under Section 2(b) and Section 2(c), Federal agencies are barred from penalizing or limiting insurers who work with cannabis-related legitimate businesses, and these insurers and their employees are protected from Federal liability. This provides clear common-sense protections for people working in the insurance industry who service legal cannabis businesses.
-
Study on Diversity and Inclusion: Under Section 3(a), the Comptroller General must study the barriers minority-owned and women-owned cannabis-related businesses face when entering the marketplace and accessing financial services. This could benefit these business owners by leading to recommendations for removing these hurdles.
Potential Negative Impacts for People
- No Specific Negative Impacts Identified: Based strictly on the provided text, there are no specific provisions that outline direct negative consequences or burdens for individuals or groups.
