What this bill would do
This bill is known as the 504 Program Level Flexibility Act. It amends the Small Business Investment Act of 1958. The legislation gives the Administrator of the Small Business Administration the authority to increase the amount of commitments to qualified State or local development companies. Specifically, for fiscal year 2027 and each fiscal year thereafter, if loan commitments could exceed the established limit, the Administrator may make commitments up to 115 percent of that limit. The Administrator must give a 30-day notice to specific congressional committees before exercising this authority. Finally, the Administrator is limited to using this authority only once during any fiscal year.

Potential Positive Impacts for People
-
Section 2 (adding subsection (j)(1) to Section 503 of the Small Business Investment Act of 1958) allows the Administrator to increase commitments for loans to qualified State or local development companies up to 115 percent of the limit if loan commitments could exceed the normal limit. This could benefit individuals and small businesses by providing greater access to funding when demand is high.
-
Section 2 (adding subsection (j)(2) to Section 503) requires the Administrator to submit a notice of intent to specific House and Senate committees at least 30 days before exercising the authority to increase loan commitments. This holds the official accountable by ensuring elected representatives in Congress are informed before the action is taken.
