What this bill would do
This bill is known as the Justice and Accountability for Representatives Engaged in Diplomacy Act or the JARED Act. It requires certain individuals representing the Federal Government before a foreign sovereign to undergo background investigations. Covered individuals must also file annual financial disclosure forms with the Office of Government Ethics. The legislation prohibits these individuals from engaging in negotiations or accepting agreements that are in their direct financial interest. The Office of Government Ethics is required to submit quarterly reports to Congress and the public that include financial disclosure forms and penalties assessed. Violators of the Act face removal, loss of security clearances, civil actions, or criminal penalties.

Potential Positive Impacts for People
-
Section 2(a)(1) requires certain individuals representing the Federal Government before a foreign sovereign to have a security clearance granted after an appropriate background investigation prior to engaging in those activities. This is a positive step to hold officials accountable and ensure that people acting for our government are properly vetted.
-
Section 2(a)(2) requires covered individuals to file annual financial disclosure forms with the Office of Government Ethics. This provision helps keep our leaders honest by letting the public see their financial standing.
-
Section 2(a)(3) prohibits covered individuals from engaging in negotiations or accepting any agreement on behalf of the United States that is in the direct financial interest of a covered person from a foreign government. This protects the people by stopping officials from using their government roles for personal financial gain with foreign entities.
-
Section 2(b) requires the Office of Government Ethics to submit quarterly reports to Congress and make them available to the public regarding financial disclosures and violations. This transparency allows everyday people to keep track of what these representatives are doing.
Potential Negative Impacts for People
- Section 2(c)(3)(B) establishes that a covered individual who knowingly violates the prohibition on negotiations or agreements can be imprisoned for not more than one year or fined. While this holds officials accountable, it represents a burden of criminal penalties and potential imprisonment for those who break the law.
