What this bill would do
The Data Center Community Reinvestment Act of 2026 proposes an amendment to the Internal Revenue Code of 1986. It establishes a new excise tax on data center electricity consumption. This tax is set at 1 cent per kilowatt-hour for facilities that primarily process, store, or transmit digital information and have a power capacity or load exceeding 1 megawatt. The revenue collected from this tax is to be divided into five specific allocations. These funds are distributed among the Land and Water Conservation Fund, the Housing Trust Fund, the Hazardous Substance Superfund, the Highway Trust Fund, and the newly created Energy Technology Trust Fund.
