Purpose and Changes
-
Mr. Booker submitted the amendment to create a point of order in the Senate against funding the execution of individuals in Federal custody using pentobarbital or another substance that the Department of Justice has found creates a risk of unnecessary pain and suffering.
-
It aims to block the consideration of any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that provides funding for executions using those drug concoctions.
-
The amendment allows this point of order to be waived or suspended in the Senate only by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
-
It also requires an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
