What this amendment would do

As folks who want to keep our elected officials accountable, we need to know what our lawmakers are trying to do with our rules. Mr. Peters submitted SA 748, which is an amendment meant to be added to the concurrent resolution for the budget, S. Con. Res. 7.

The purpose of this amendment is to create a new rule in the Senate. Specifically, it aims to add a point of order against certain legislation.

Here is what the amendment aims to change or add to the bill:

  • It adds a rule that it shall not be in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would increase energy exports if the sitting President has declared a national emergency with respect to energy.
  • It sets a rule that this new restriction can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
  • It requires an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, to sustain an appeal of the ruling of the Chair on a point of order raised under this new section.
