What this amendment would do

This amendment, submitted by Mr. Welch, aims to replace section 113 of a previous amendment. Its purpose is to establish duties on goods imported into the United States from foreign countries that purchase crude oil or natural gas originating from the Russian Federation.

Key Changes and Additions:

  • Imposition of Duties: The President must increase the duty rate for all goods imported from specific foreign countries to a rate of up to 100 percent ad valorem within 30 days of the Act's enactment.

  • Targeted Countries: Duties apply to foreign countries that were among the 5 largest importers of Russian crude oil or natural gas in the 12 months before the Act and knowingly made new purchases of these resources starting 30 days after enactment.

  • Adjustments and Monitoring: The United States Trade Representative can adjust duty rates between zero and 100 percent based on whether a country increases or decreases its purchase of Russian oil and gas. Additionally, every 180 days, the 5 largest importers of Russian crude oil and natural gas must be identified and subjected to these duties.

  • Exceptions and Rules: An exception exists for countries whose Russian natural gas imports were less than 15 percent of total Russian exports during the specified period and who have taken significant steps to reduce those imports. These duties are in addition to any other existing fees, taxes, or charges.

  • Accountability: The President or the United States Trade Representative must provide written justification and methodology to appropriate congressional committees 10 days before imposing or modifying any duties.
