What this amendment would do
SA 6640, submitted by Mr. Schmitt, aims to add the American Supply Chain Sovereignty Initiative to bill S. 4784.
The purpose of this amendment is to establish a neutral, federally protected public utility to secure United States national security and Department of Defense mobilization capabilities. It specifically seeks to counter the influence and infiltration of global maritime logistics networks by state-directed entities and covered logistics platforms (such as "LOGINK").
The amendment aims to add the following to the bill:
- Data Integration: Authority for the Secretary of Transportation to collect voluntary confidential business information and public sector data to optimize routing, reduce inflation, and deter cargo theft.
- Expedited Service: The creation of an expedited service tier for specific cargo (such as essential commodities or CTPAT validated participants) that uses a trusted data chain to ensure data has not been masked by covered logistics platforms.
- Information Sharing: A tiered architecture for sharing operational data with specific entities (like ocean carriers and port authorities) while protecting confidential business information and prohibiting the resale of data.
- Security and Protections: Mandatory zero-trust architecture for digital systems, immunity from certain legal discoveries and cyber liabilities, and protections to ensure data is not used to intervene in labor disputes.
- Interagency Coordination: Limited data sharing with the Departments of Defense, Homeland Security, Agriculture, and Commerce to support national mobilization and detect anomalous transshipments.
- Funding: Authorization of $22,000,000 annually from fiscal year 2027 through 2032 to administer the Initiative and support DHS systems integration.
