What this amendment would do

The amendment, submitted by Mr. Johnson, proposes to add a section called the Guidance Out Of Darkness Act (or the GOOD Act) to bill S. 4784.

The purpose of this amendment is to require agencies to publish guidance documents—which are statements of general applicability that do not have the force and effect of law—on the internet.

The amendment aims to add the following requirements to the bill:

  • Publication of Documents: Agencies must publish guidance documents on the date they are issued. Any guidance documents already in effect must be published within 180 days of the Act's enactment.
  • Centralized Location: The Director of the Office of Management Budget will designate a single internet website where all these documents must be published. Agencies must also put prominent hyperlinks to this site on their own websites.
  • Organization: Documents must be categorized as guidance documents and divided into subcategories.
  • Handling Rescinded Documents: When a guidance document is rescinded, the agency must keep the document at the designated location and mark it as rescinded, including the date and any applicable court case number.
  • Exemptions: This does not apply to documents or information that are exempt from disclosure under the Freedom of Information Act.
