What this amendment would do

SA 6625, submitted by Mr. Sheehy, aims to add a new section to title 10 of the United States Code. This addition would allow the Federal Government to go to court to get an order of specific performance to force the delivery of covered information under defense contracts.

The amendment proposes the following:

  • Court Authority: The Federal Government can ask a district court to order the delivery of information in a format the court finds necessary. The court can also decide the government's rights to the information and order the removal or correction of improper markings.

  • Requirements for Action: This legal action can only happen if a contractor fails or refuses to deliver the information within 30 days after a contracting officer issues a final decision requiring that delivery.

  • No Delays: If a contractor appeals or challenges the contracting officer's decision, that process will not stop or affect the government's ability to bring this action in court.

  • Key Definitions:

    • Covered information includes technical data, computer software, software documentation, or intellectual property that must be delivered under a legal instrument.
    • Covered legal instrument refers to an agreement, contract, or other legal instrument.
    • Delivery means making the information available or providing it in any manner.
