What this amendment would do

SA 6603, submitted by Mr. Scott of Florida, aims to change Section 8531 of the National Defense Authorization Act for Fiscal Year 2026.

The purpose of this amendment is to add a new subsection regarding the Non-SDN Chinese Military-Industrial Complex Companies List. Specifically, it adds the following requirements:

  • The Secretary of the Treasury may add foreign persons to the list if they qualify based on a report submitted by the President and are not already listed. This must happen no later than one year after that report is submitted.

  • If any foreign person is added, the Secretary of the Treasury must publish a revised list in the Federal Register.

  • If a qualifying foreign person is not added to the list, the Secretary of the Treasury must provide a written justification for each person not added in an annual report to the appropriate congressional committees.
