What this amendment would do
This amendment, known as the Eliminate PRC Organized Crime Act, aims to add a new section to the Foreign Assistance Act of 1961. Its purpose is to create a program that helps law enforcement agencies in Latin America and the Caribbean build the capacity to disrupt transnational criminal organizations linked to the People's Republic of China (PRC).
The amendment seeks to change the law by allowing the Secretary of State, in coordination with the Attorney General, to provide specific types of assistance to target criminal activities such as:
- Narcotics trafficking
- Money laundering and illicit finance
- Transnational repression
- Illegal, unreported, and unregulated (IUU) fishing
- Foreign interference
To achieve this, the program may provide:
- Consultations between foreign law enforcement and U.S. federal, state, and local agencies.
- Training on asset forfeiture and financial investigations.
- Technical assistance, including open-source intelligence and digital forensics.
- Vetting and screening to ensure receiving agencies are not compromised by PRC-linked organizations.
The amendment also requires the Secretary of State to submit a detailed report to appropriate congressional committees within one year. This report must identify the assistance provided, summarize known PRC-linked criminal activity in the region, and analyze PRC efforts to expand law enforcement cooperation agreements in these countries.
