What this amendment would do
SA 6568, submitted by Mrs. Hyde-Smith, aims to add a section to bill S. 4784 titled "Protection of Lawfully Owned Personal Property During Execution of Military Orders."
The purpose of this amendment is to ensure that servicemembers and their dependents are not prohibited from transporting, possessing, owning, or using firearms (excluding silencers), firearm parts, accessories, magazines, and ammunition that were lawfully acquired before their military orders were issued.
-
Coverage Period: These protections begin on the date military orders are issued and end 180 days after the orders are completed or concluded.
-
State Restrictions: States cannot require these individuals to register, provide notice, or pay fees for the importation, possession, or ownership of these items during the specified period.
-
Limitations: The amendment does not allow for:
- Commercial sales or transfers that violate state laws.
- Violations of Federal law, Department of Defense regulations, or rules on military installations.
- Violations of state or local laws regarding ammunition use for public-safety or fire-safety.
- Carrying concealed firearms in violation of state laws governing concealed carry permits.
-
Sale and Transfer: Any sale or transfer of these items must be done through a lawful transfer to a licensed manufacturer, dealer, importer, or recipient in a jurisdiction where the item is legal.
