What this amendment would do
This amendment, submitted by Mr. Warner and Mr. Cornyn, aims to add a new section (Sec. 2869a) to the law regarding critical housing areas and community partnership response plans. Its purpose is to address shortages of affordable and available housing that affect members of the armed forces and their families.
The amendment adds the following requirements:
-
Designation of Critical Housing Areas: The Secretary of Defense must create a process to identify geographic areas near military installations where housing shortages materially affect service members and their families.
-
Criteria for Designation: The Secretary must develop criteria based on factors such as rental vacancy rates, housing cost burdens, the availability of housing for different family sizes and junior enlisted members, commuting patterns, temporary lodging options, and barriers to housing production like zoning and school capacity. Public comments from stakeholders must be included in these criteria.
-
Maintenance and Reporting: The Secretary of Defense must maintain and update a list of these areas at least once a year and notify congressional defense committees of any changes to these designations.
-
Community Partnership Response Plans: For every designated critical housing area, a response plan must be developed. This process involves consulting with various government bodies (State, local, Tribal, and territorial), housing agencies, planning organizations, and infrastructure authorities.
-
Plan Requirements: Each plan must include an assessment of market conditions, the drivers of unaffordability or shortages, regulatory barriers, existing tools being used to fix these issues, recommended actions, estimated costs, timelines, and any suggested legislative or administrative actions.
-
Coordination and Annual Reports: The Secretary of Defense must coordinate these activities with other Department of Defense housing authorities and submit an annual report to congressional defense committees by March 1. This report must list the designated areas, the status of the response plans, performance outcomes, and any identified regulatory or statutory barriers.
