What this amendment would do

SA 6516, submitted by Mr. Warner, aims to add a new section to bill S. 4784 to create a pilot program. The purpose of this program is to improve how the Department of Defense handles the intake, evaluation, and disposition of unsolicited proposals for defense capabilities.

Key Changes and Additions

The amendment requires the Secretary of Defense to establish this program within 180 days of the Act's enactment. It adds the following requirements:

  • Standardized Process: The program must provide a common electronic way to submit proposals and clear guidance on what information is needed for review.

  • Accountability for Responses: The Department must notify an offeror if a proposal is complete within 30 days of receipt. If complete, a written disposition explaining the basis for rejection, referral, or further consideration must be provided within 90 days.

  • Alternative Pathways: If a proposal cannot be awarded or negotiated under specific regulations, it must be considered for other pathways, such as prize competitions, broad agency announcements, or Small Business Innovation Research topics.

  • Priority Areas: Priority will be given to proposals that could materially improve:

    • Production capacity and domestic manufacturing.
    • Supply chain resilience and cyber resilience.
    • Repair, maintenance, or sustainment.
    • Cost or schedule performance for defense requirements.
  • Reporting: The Secretary must brief congressional defense committees 180 days after establishing the program and provide annual reports for three years detailing the number of proposals received, the time taken to handle them, and participation data for small businesses and other contractors.

  • Legal Constraints: This amendment does not change existing regulations regarding sole-source contracts or the award of contracts based on unsolicited proposals.
