What this amendment would do
The amendment, known as the U.S. Technology Procurement and Access to Trusted Hardware Act (or the U.S. Tech PATH Act), adds a new subtitle to the bill. Its purpose is to create a system that helps foreign government partners buy "trusted" cyber and digital technologies from the United States and its allies instead of from strategic competitors like the People's Republic of China.
The amendment aims to add the following to the bill:
-
The U.S. Cyber and Digital Technology Procurement Program: A program run by the Department of State to streamline how foreign partners buy trusted U.S. technology. This includes software, hardware, cybersecurity products, telecommunications equipment, and AI-related tools.
-
Risk and Vetting Measures: It requires the Secretary of State to vet partners to ensure they do not commit human rights abuses or corruption. It also prohibits funding for "foreign countries of concern" or entities under U.S. sanctions.
-
Administrative Infrastructure: It establishes an Office of United States Technology Procurement to manage the program and encourages placing technology experts at U.S. overseas missions.
-
Funding and Oversight: It authorizes $500,000,000 annually from 2026 through 2031 for the program and $2,000,000 annually from 2026 through 2028 for the office. It also mandates annual reports to Congress and reviews by the Government Accountability Office.
-
Market Protection: It sets a policy to support market-based competition and prevents the government from unduly interfering with private sector competition among U.S. providers.
