The purpose of this amendment is to change and add specific language to the following laws:

  • Investment Company Act of 1940
  • Securities Act of 1933
  • Securities Exchange Act of 1934

The amendment aims to update these acts to include plans that meet the requirements of section 403(b) of the Internal Revenue Code of 1986, provided they meet certain conditions. These conditions include being subject to title I of the Employee Retirement Income Security Act of 1974, having an employer agree to serve as a fiduciary for investment selection, or being a governmental plan where investment alternatives are reviewed and approved by the employer, a fiduciary, or another person acting for the employer.
