What this amendment would do
SA 6462, submitted by Mr. Hickenlooper, aims to add a new section (Sec. 2247) to the law. The purpose is to allow the Superintendent of a Service Academy to enter into contracts with a covered foundation for specific activities.
These activities include:
- Planning
- Design
- Construction
- Equipping
- Maintenance of facilities and other projects that support the Service Academy mission
The amendment adds several rules to keep things honest. Any agreement must:
- Not make the U.S. Government liable to the foundation.
- Not stop officials from doing their duties in a fair and objective way.
- Not hurt the integrity or appearance of integrity of any program or individual.
- Follow the Joint Ethics Regulation.
- Be approved by an attorney from the military department.
Additionally, the Secretary of the military department must brief the House and Senate Committees on Armed Services by the end of any fiscal year that these contracts are used for campus improvement projects.
A covered foundation is defined as a 501(c)(3) nonprofit that the Secretary determines operates exclusively to support the Service Academy in areas like recruiting, athletics, institutional development, or academic, leadership, and character development.
