What this amendment would do

SA 6441, submitted by Mr. Lankford, aims to add a new section to bill S. 4784 regarding the limitation on use of waiver authority for transfer of F-35 aircraft to Turkey.

The purpose of this amendment is to prevent the use of waiver authority under section 1245 of the National Defense Authorization Act for Fiscal Year 2020 until specific conditions are met.

Specifically, the Secretary of State, in consultation with the Secretary of the Treasury, must certify to the following appropriate committees of Congress that Turkey has ended forms of support for foreign terrorist organizations:

  • The Committee on Foreign Relations of the Senate
  • The Committee on Banking, Housing, and Urban Affairs of the Senate

The amendment defines support for terrorism as:

  • Harboring of individuals designated for terrorism
  • Use of domestic financial institutions to transfer funds to designated individuals
  • Materiel transfer to designated individuals
