What this amendment would do
SA 6400 is an amendment to bill S. 4784 that focuses on the multilateral alignment of controls on semiconductor manufacturing equipment. Its primary purpose is to protect the national security of the United States by ensuring that advanced semiconductor technology and equipment do not reach adversaries, specifically those in countries of concern.
The amendment aims to add the following to the bill:
-
Diplomatic Efforts: It requires the Secretary of Commerce and the Secretary of State to engage allied supplier countries to adopt "countrywide controls" and license requirements (with a policy of denial) for exporting equipment or providing servicing to covered facilities in countries of concern.
-
Identification of Chokepoints: Covered agency heads must identify all covered semiconductor manufacturing equipment and facilities and submit this list to congressional committees.
-
US-Led Controls: The Secretary of Commerce must issue regulations applying countrywide controls to equipment produced in the US and restrictions on covered facilities in countries of concern.
-
Enforcement Against Non-Compliant Allies: If an allied supplier country does not implement similar controls after diplomatic efforts are exhausted, the US will establish jurisdiction over and apply controls to equipment exported from that allied country.
-
Accountability and Reporting: The amendment mandates regular briefings and annual reports to Congress detailing the status of diplomatic efforts, the list of covered equipment and entities, and certifications regarding the effectiveness of the export licenses.
-
Waivers and Reversals: It allows for a one-time 90-day national security waiver for certifications and provides a mechanism to terminate or reimpose controls based on the actions of allied supplier countries.
