What this amendment would do

Mr. Heinrich submitted SA 6352 to be added to bill S. 4784. The purpose of this amendment is to prohibit the transfer of plutonium to private entities for commercial use.

Key changes and additions include:

  • Prohibition of Transfers: The United States, including the Nuclear Regulatory Commission and the Department of Energy, cannot transfer the possession or title of any plutonium to a private entity for profit-based commercial activities, such as selling generated electricity.

  • Retrieval of Material: The Secretary of Energy must retrieve any plutonium currently held by a private entity for commercial activity within 90 days of the enactment. If not retrieved, the possession is considered a violation.

  • Import and Processing Bans: Private entities are prohibited from importing separated plutonium for commercial activity. Additionally, facilities licensed to reprocess spent nuclear fuel cannot use processes that result in the separation of plutonium.

  • Specific Exceptions: These rules do not apply to plutonium that is 80 percent or more plutonium-238, transfers to contractors operating facilities for the Department of Energy where the U.S. keeps the title, or transfers for radioactive waste management and nuclear proliferation programs.
