What this amendment would do
SA 6311 is an amendment submitted by Mr. Moran to bill S. 4784. Its purpose is to change how benefits and services are handled for surviving spouses who remarry.
Changes to the Survivor Benefit Plan
The amendment aims to modify Section 1450 of title 10, United States Code, by:
- Removing language regarding remarriage before age 55 in section headings and specific paragraphs.
- Stating that if a surviving spouse or former spouse remarries and is entitled to an annuity from a subsequent marriage when that marriage ends, they must choose which one of the two annuities to receive.
- Requiring the Secretary to resume annuity payments for surviving spouses who remarried before age 55 and before the date this paragraph is enacted. This resumption happens either one year after enactment or on the first day of the first month after enactment for those who transferred payments to children under specific 2019 provisions.
Changes to TRICARE Program
The amendment aims to expand the definition of a dependent under Section 1072(2) of title 10, United States Code, to include:
- A remarried widow or widower whose subsequent marriage has ended because of annulment, divorce, or death.
- 6/24/2026
