What this amendment would do
SA 6288, submitted by Mr. Lankford, aims to add a new section to the Homeland Security Act of 2002 to create the Early Migration Alert Program (EMAP).
The purpose of this program is to:
- Lead the Department's dissemination of information about the release and movement of aliens into the United States.
- Create formal partnerships with regional stakeholders to analyze, integrate, and share this information.
Key Changes and Additions
The amendment adds the following requirements and provisions:
-
Information Sharing: At least 24 hours before releasing an alien into the U.S., the Secretary (consulting with the Secretary of Health and Human Services and acting through the Commissioner of U.S. Customs and Border Protection and the Director of U.S. Immigration and Customs Enforcement) must provide specific details to relevant State, local, Tribal, and territorial government personnel. This information includes:
- The number of aliens being released.
- The number of those aliens with known criminal histories.
- Initial and final destinations where the aliens intend to settle.
-
Notification System: The Department must develop an electronic mail notification system and a list of government personnel to receive this data, provided they have a verified official government email address on file.
-
Funding and Timeline: The program applies to any alien apprehended or released on or after the enactment date. It authorizes $400,000 in appropriations for fiscal years 2026 and 2027.
