What this amendment would do

This amendment, submitted by Ms. Hassan to bill S. 4784, adds a new section called the Reporting Efficiently to Proper Officials in Response to Terrorism Act of 2026 (or the REPORT Act).

The purpose of this amendment is to create a requirement for officials to report on acts of terrorism that occur in the United States. It aims to add the following to the bill:

  • Reporting Requirements: The Secretary of Homeland Security, the Attorney General, the Director of the FBI, and potentially the head of the National Counterterrorism Center must submit an unclassified report (which can have a classified annex) to specific congressional committees. This must be done within 1 year after the primary government agency finishes its investigation.

  • Public Access: These reports must be made available on a website that the public can access.

  • Report Content: Reports must include known facts of the terrorism act, identify security gaps to prevent future acts, and provide recommendations for improvements to national security, including possible changes to laws or law enforcement practices.

  • Exceptions and Limits: Information can be withheld if officials determine it could jeopardize an ongoing prosecution or investigation, though they must notify the congressional committees. The amendment also specifies that the National Counterterrorism Center does not get any investigatory or prosecutorial authority through this section.

  • Duration: This section of the act is set to terminate 5 years after the date it is enacted.
