What this amendment would do

SA 6249, submitted by Ms. Hassan and Mrs. Blackburn, aims to add a section to bill S. 4784 focused on Addressing Stolen Sensitive Data.

The amendment proposes the following changes and additions:

  • Strategies for Identification: It requires the President, through the Secretary of Defense and the Director of National Intelligence, to create strategies to find classified information and covered data (which includes trade secrets, intellectual property, and biometric, medical, and financial data of United States persons) that are unlawfully held by foreign entities. These strategies must also determine if the data was encrypted or decrypted by those entities.

  • Strategies for Action: The President must develop strategies to address this stolen information. If the Secretary and Director jointly decide it is in the economic and national security interest of the United States, they may attempt to destroy, manipulate, or recover encrypted data that has not yet been decrypted by the foreign entity.

  • Notification and Reporting: When practicable, the lawful owners of the data should be informed of the intent to act and the outcome of the recovery, destruction, or manipulation. Additionally, the Secretary and Director must provide a report to Congress within one year detailing their strategies, actions taken, and any recommendations for further action.
