What this amendment would do
SA 6240, submitted by Mr. Kennedy, aims to add a section titled "PROTECTION FROM TREATMENT-RELATED CREDIT HARM" to bill S. 4784.
The purpose of this amendment is to make the following changes:
-
Define Medical Debt: It defines "medical debt" as debt that comes from receiving medical devices, products, or services.
-
Update the Fair Credit Reporting Act: It changes the law to exclude any adverse information related to medical debt from being reported, including debt that was charged to profit or loss, placed for collection, or subjected to similar actions. However, it does not stop consumer reporting agencies from collecting this information.
-
Restrict Use of Information: It requires the Director of the Bureau of Consumer Financial Protection to update regulations within one year of the law's enactment. These updates must stop creditors from using or getting information about a consumer's medical debt when deciding whether to give them credit.
