What this amendment would do
The amendment, also known as the Secure And Fair Employment in Federal Contracting Act or SAFE Contracting Act, aims to require federal contractors and subcontractors to use the E-Verify Program.
It adds new requirements to the bill by mandating the following:
- Certification: Any entity bidding for a contract with an executive agency must certify that they and their subcontractors are enrolled in and complying with the E-Verify Program.
- Contract Restrictions: Executive agencies are prohibited from awarding contracts to entities that do not provide this certification.
- Monitoring and Transparency: Agencies must confirm enrollment before awarding contracts, monitor continued compliance, and post their findings on a public website annually.
- Penalties for Noncompliance: Entities or subcontractors that fail to return to full compliance within 30 days of receiving a notice of noncompliance will be referred for suspension and debarment proceedings.
- Reporting: The Administrator must submit annual reports to congressional committees summarizing agency findings and the number of entities referred for suspension or debarment.
