What this amendment would do
Mr. Kennedy submitted SA 6223, which adds the U.S.-South Africa Bilateral Relations Review Act to bill S. 4784. The purpose of this amendment is to force a formal evaluation of the relationship between the United States and South Africa due to concerns over South Africa's foreign policy and internal governance.
The amendment aims to add the following to the bill:
-
Comprehensive Review: It requires the President, working with the Secretary of State, Secretary of Defense, and other agencies, to conduct a full review of the bilateral relationship between the two countries.
-
Reporting and Certification: The President must submit a report to Congress within 120 days. This includes a certification stating if South Africa has done things that undermine the national security or foreign policy interests of the United States.
-
Sanctions List: The President must provide a classified report listing senior South African government officials and ANC leaders who have engaged in human rights abuses or corruption that would qualify them for sanctions under the Global Magnitsky Human Rights Accountability Act.
-
Trade Penalties: If the President certifies that South Africa has undermined U.S. national security or foreign policy interests, the President must end South Africa's eligibility for certain trade preference programs, specifically those under the Trade Act of 1974 and the African Growth and Opportunity Act.
