What this amendment would do
Mr. Kennedy submitted an amendment to bill S. 4784, which is referred to as the Diego Garcia Treaty Oversight Act.
The purpose of this amendment is to add requirements for any modification of the covered agreement, which is the December 30, 1966, agreement regarding the availability of the British Indian Ocean Territory for defense purposes.
The amendment aims to add the following changes:
- Senate Approval: Any modification to the covered agreement requires the advice and consent of the Senate.
- Funding Restrictions: Federal funds cannot be used to modify the covered agreement without the advice and consent of the Senate.
- Presidential Reporting: Before negotiating any modification, the President must provide the appropriate committees of Congress with a report in both classified and unclassified forms.
The required report must detail:
- The national security rationale for the modification.
- How the modification affects United States operational control of Diego Garcia.
