What this amendment would do

The amendment, known as the Protecting Our Courts From Foreign Manipulation Act of 2025, aims to add a new subtitle to the bill to regulate foreign funding of civil lawsuits in Federal courts.

Its primary purpose is to create transparency and set limits on foreign third-party litigation funding through the following changes:

  • Disclosure Requirements: It requires parties or their lawyers in civil actions to disclose and certify in writing if any foreign person, foreign state, or sovereign wealth fund has a right to receive payments based on the outcome of the case. This information must be provided to the court, other parties, the Attorney General, and the Principal Deputy Assistant Attorney General for National Security.

  • Prohibitions: The amendment makes it unlawful for parties or lawyers to enter into agreements where the funding for a civil action is sourced, even partially, from a foreign state or a sovereign wealth fund. Any such agreements would be considered null and void.

  • Accountability and Reporting: It subjects failures to disclose or supplement information to sanctions under the Federal Rules of Civil Procedure. Additionally, it requires the Attorney General to provide an annual report to Congress detailing the identities of foreign funders, the districts involved, the estimated amounts of money used, and the subject matters of those cases.

  • Applicability: These rules would apply to any civil action that is already pending or starts on or after the date the Act becomes law.
