What this amendment would do

SA 6217, submitted by Mr. Kennedy, aims to add Hospital Price Transparency Requirements to the bill. It amends Section 2718(e) of the Public Health Service Act to set specific rules for how and when hospitals make their price lists public.

The amendment adds the following changes:

  • Timing: Existing hospitals must establish and update their public lists within 6 months of the enactment date and every year after. New hospitals must do so within 6 months of starting operations.

  • Searchability: Hospitals are prohibited from using webpage coding to shield required information from online search results.

  • Penalties: Hospitals that fail to comply face daily civil monetary penalties based on their bed count:

    • 30 beds or fewer: up to $600 per day.
    • More than 30 and up to 550 beds: $20 per bed per day.
    • More than 550 beds: $11,000 per day.

  • Accountability: The Secretary must publish a list of hospitals that are not in compliance. This list will be published 280 days after enactment and every 180 days following that.
