What this amendment would do

SA 6182, submitted by Mr. Warnock, is an amendment to bill S. 4784. Its purpose is to establish rules for the handling and release of covered records, which are tapes or documents from the FBI's surveillance of Dr. Martin Luther King, Jr. that were subject to a January 31, 1977, court order.

The amendment aims to add the following to the bill:

  • Findings: It acknowledges that Dr. King was subjected to an invasive government surveillance campaign without judicial review and that the privacy interests of the recorded individuals outweigh the historical value of the records.

  • Access: It requires the Archivist of the United States to give the surviving children of Dr. Martin Luther King, Jr. exclusive access to view the records after the current court-ordered seal expires.

  • Sealing and Release: The Archivist must keep the records under seal for 60 years after the current seal expires. Once that 60-year period ends, the records will be released to the public using standard Archivist protocols.
