What this amendment would do
SA 6174, also known as the Bureau of Industry and Security License Administration Enhancement Act, aims to add a new title on export controls to bill S. 4784. This amendment focuses on changing how export control licenses are handled and adding new advisory and review requirements.
Key Changes and Additions:
-
License Administration: It requires that certain communications, such as "is-informed" letters or targeted regulatory guidance, be handled using the same interagency process as standard licenses. These communications must terminate within 60 days unless the Secretary publishes them in the Federal Register or the Code of Federal Regulations.
-
Presumption of Denial: The Secretary must publish the standards and factors used by licensing officers when a "presumption of denial" standard is applied. These standards must be submitted to specific House and Senate committees 7 days before being made public.
-
Technical Advisory Committees: The amendment creates technical advisory committees made up of industry, national security, and academic experts. These committees will advise the Secretary on topics such as:
- Global technology supply chain stability.
- National security challenges and technical parameters for export controls.
- Specific technology areas including AI, quantum computing, semiconductors, biotechnologies, aerospace, and weapons of mass destruction.
- These committees must meet at least every 120 days and provide annual assessments and recommendations to the Secretary and Congress.
-
Integrated Circuits Review: The Secretary must review the implementation of the interim final rule regarding "Additional Due Diligence Measures for Advanced Computing Integrated Circuits" (or a similar successor rule). A report on the findings and any changes made to the rule must be submitted to the appropriate congressional committees within 120 days of the Act's enactment.
