Changes and Additions
The amendment aims to add the following to the bill:
-
Compliance Requirements: It amends the Export Control Reform Act of 2018 to state that no person may fail to establish, maintain, or enforce a required export compliance program.
-
Secretary of Commerce Authority: It allows the Secretary of Commerce to create regulations requiring people involved in covered export activities to have export compliance programs. These programs may include:
- Internal policies, procedures, and controls.
- Risk assessments and export authorization processes to screen for unauthorized end-uses, end-users, or destinations.
- A designated export compliance officer.
- Ongoing employee training.
- An audit function to test the program.
-
Covered Export Activities: This includes activities under the Export Administration Regulations involving items or destinations the Secretary determines have a heightened risk of diversion or unauthorized transfer, as well as high-volume exports of specific advanced computing integrated circuits, computers, electronic assemblies, or related products.
-
Applicability: These rules apply to violations of the Export Control Reform Act of 2018 or its regulations, orders, and licenses committed on or after the date the Act is enacted.
