What this amendment would do
SA 6138, submitted by Ms. Duckworth and Mr. Durbin, aims to add a section to title X of bill S. 4784 regarding a report on domestic deployments.
The amendment intends to stop any funds from being used for domestic deployments of the Armed Forces for fiscal year 2027 until the Secretary of Defense gives the congressional defense committees a report on how domestic deployments since January 20, 2025, have affected military readiness.
There are exceptions to this funding restriction for:
- Deployments along the southwest border of the United States.
- Deployments requested or consented to by a destination State governor.
- Deployments requested or consented to by the Chief Executive of an Indian Tribal Government on the tribal land where forces are deployed.
- Deployments to the District of Columbia requested or consented to by the Mayor of the District of Columbia.
The required report must include:
- Evaluations of authorities used for deployments.
- A list of deployments with orders, dates, number of servicemembers, locations, requested resources, and if State authorities were informed.
- Details on agreements with local authorities, modified rules of engagement, use of force incidents, arrests, detentions, and disciplinary actions.
- Impacts on military readiness, including morale, personnel loss, and reputational harm.
- Impacts on domestic issues in cities, such as crime statistics, civil unrest, homelessness, and civil immigration enforcement.
- Evaluations of training provided to members before deployment.
- Individual costs for each deployment, including personnel, equipment, and financial costs.
- Data on approved, denied, or pending deployment requests and waivers.
After the initial report, the Secretary of Defense must provide updated reports every 90 days.
