What this amendment would do
SA 6137, submitted by Ms. Duckworth and Mr. Durbin, aims to add a new section to title 10 of the United States Code to limit how the Armed Forces provide support to civilian law enforcement activities.
The amendment changes the process by requiring the President to submit a notification and written justification to Congress before the Secretary of Defense can provide support under sections 272, 273, or 274. This justification must include:
- The agency receiving support.
- The budget, timeline, delivery schedule, and completion date.
- The source and planned spending of funds.
- Details on sustainment arrangements and funding, if applicable.
- Project objectives and an evaluation framework for performance metrics.
- Information on the amount, type, and purpose of support given to the agency in the previous three fiscal years.
Additionally, the amendment limits the timing of this support. The Secretary of Defense cannot provide support for more than 30 days unless a specific joint resolution of approval is enacted by either House of Congress.
