What this amendment would do

SA 6090, submitted by Mr. Kelly and Mr. Cotton, aims to change and add requirements for defense microelectronics products and services to meet trusted supply chain and operational security standards.

The amendment proposes the following changes to the National Defense Authorization Act for Fiscal Year 2020:

  • It adds provenance verification technologies to ensure the traceability of assembly, fabrication, and design processes, no matter where they are located.

  • It requires the Secretary to recognize lifecycle traceability methods and secure silicon provenance technologies as providing assurance that is equal to or greater than manufacturing at a Defense Microelectronics Activity-accredited trusted supplier, if validated by a risk-based assessment.

  • It expands the scope to include fabrication facilities that operate under validated alternative assurance methodologies.

  • It adds a Pilot Program for Assured Fabless Microelectronics to be established within 210 days of enactment to see if secure silicon provenance technologies can work as an alternative assurance pathway for microelectronics designed by United States persons and made at commercial facilities.

  • It adds Reporting Requirements where the Secretary must submit a report to congressional defense committees within 180 days after the enactment of the National Defense Authorization Act for Fiscal year 2027. This report must describe:

    • Criteria for approving alternative assurance methods.
    • How this applies to commercial fabrication facilities run by United States partners and allies.
    • Impacts on access to advanced node technologies.
    • Participation by fabless semiconductor companies in the United States.
