What this amendment would do
This amendment aims to create special base rates of pay for Federal correctional officers employed by the Bureau of Prisons. It intends to add specific pay increases to the law to support these officers.
Key Changes and Additions:
- Pay Increases: It provides a 35 percent increase to the applicable General Schedule base rate, LEO special base rate, or wage rates for certain covered employees.
- Eligibility: The pay increase applies to officers whose duties primarily relate to the custody, control, or supervision of inmates or routinely include direct inmate contact in a custodial setting.
- Limits: These special rates cannot exceed specific levels of the Executive Schedule (Level V for some and Level IV for others).
- Sunset and Review: The authority for these pay rates expires 5 years after the Act is enacted unless the Inspector General of the Department of Justice finds that the Bureau of Prisons has made measurable progress in:
- Reducing or eliminating augmentation (the use of non-custodial employees to do the duties of Federal correctional officers).
- Reducing excessive mandatory overtime.
- Impact Assessment: The Inspector General must report to Congress on how these pay rates affected recruitment, retention, and institutional safety.
