This amendment, proposed by Mrs. Shaheen and Mr. Grassley, aims to add Section 539F to the bill to establish specific rights for victims under the Uniform Code of Military Justice.
The amendment changes the law by adding the following rights:
-
The right to receive a medical forensic examination without being prevented from doing so or being charged for it.
-
In cases of sexual assault, the right to have an evidence collection kit or its contents preserved for the shorter of 20 years or the maximum applicable statute of limitations, without charge.
-
The right to be told the results of a sexual assault evidence collection kit (such as toxicology reports or DNA profile matches) if it does not compromise an ongoing investigation.
-
The right to be informed in writing about policies for collecting and preserving these kits.
-
The right to know the location and status of the evidence collection kit.
