What this amendment would do

This amendment focuses on Sexual Assault Survivors' Rights and proposes the following changes:

State Funding Incentives The amendment changes how the Attorney General increases covered formula grants for States. It creates three funding tiers based on how a State provides survivors' rights (as outlined in section 3772 of title 18, United States Code):

  • 60 percent of funds go to States with a law providing these rights.
  • 25 percent of funds go to States using a combination of laws, regulations, practices, and policies to provide these rights.
  • 15 percent of funds go to States using a combination of laws, regulations, practices, and policies that provide rights that are substantially similar.

States can only receive an allocation from one of these three tiers.

Evidence Kits The amendment changes the requirement for preserving evidence kits. It replaces the previous time limit (the shorter of the maximum statute of limitations or 20 years) with a requirement to preserve them for not less than 15 years.

Evidence Kit Requests The amendment changes the process for requesting notification before an evidence kit is disposed of or for further preservation by replacing the requirement for a written request with a general request.
