What this amendment would do
The Blocking Large-scale Adversarial Distillation Efforts Act of 2026 (or BLADE Act) is an amendment to bill S. 4784. Its purpose is to protect closed-source artificial intelligence models owned by United States persons from model extraction attacks conducted by persons of concern.
The amendment aims to add a new title to the bill that focuses on the following:
-
Identification and Assessment: It requires the Secretary of Commerce to identify persons of concern and fraudulent account network providers who engage in model extraction attacks. This includes conducting assessments of the methods used, the economic and national security consequences, and creating an AI Model Extraction Attackers List.
-
Information Sharing: It establishes a way for AI model owners to voluntarily and confidentially share information about attacks with the Department of Commerce.
-
Deterrence and Punishment: The amendment provides tools to hold attackers accountable, including:
- Determining if entities should be added to the Entity List.
- Allowing the President to block and prohibit transactions involving the property of identified persons of concern.
-
Guidance: It mandates the publication of best practices to help detect, prevent, and respond to these attacks.
