What this amendment would do
SA 6064, submitted by Mr. Lujan, aims to change how costs are recovered for space launch support services to increase space launch capacity. It adds a new section to the bill regarding the modification of special authority for provision of space launch support services.
The amendment adds a "Marginal-cost billing" method for specific situations called covered circumstances. The purpose is to:
- Require the Secretary of a military department to use marginal-cost billing as the only method of cost recovery instead of other existing subparagraphs.
- Limit recoverable costs to the incremental costs actually incurred for coordination and integration services, such as safety integration, deconfliction services, and airspace coordination.
- Exclude costs like capital investment, fixed overhead, or costs that would happen even if the commercial entity was not operating.
The amendment also defines a covered circumstance as when a commercial entity operates adjacent to a military installation, the demand is limited to coordination and integration services, and the operation does not delay or displace military operations or require material increases in personnel, capital investment, or infrastructure.
