What this amendment would do

SA 6013, submitted by Mr. Schiff, aims to add a section to bill S. 4784 focused on Collaboration on Adversarial Threats and AI Security Risks.

The purpose of this amendment is to provide an antitrust exemption for non-Federal entities that exchange information or assistance to handle "covered artificial intelligence security risks." These risks include things like the development of weapons, disruptions to critical infrastructure, or AI being stolen by a covered nation.

Specifically, the amendment seeks to change the bill by adding the following:

  • Legal Protections: It prevents certain exchanges of information or coordinated strategies to limit the release or deployment of AI from being considered violations of antitrust laws, provided they are done in good faith for security purposes.
  • Reporting Requirements: Non-Federal entities must give written notice to the Attorney General and the Federal Trade Commission if they coordinate to delay or limit AI development or deployment.
  • Government Oversight: The Attorney General or the Federal Trade Commission can seek an injunction if they find entities are not acting in good faith or are engaging in anticompetitive acts.
  • Privacy: Information shared with the government regarding these security risks is exempt from public disclosure.
