What this amendment would do
The amendment, known as the Freedom to Heal Act of 2026, aims to change the Controlled Substances Act by adding a special registration process for physicians.
The purpose of this addition is to allow the Attorney General to register physicians so they can directly administer eligible investigational drugs in schedule I to eligible patients under the Right to Try law.
To get this registration, physicians must provide:
- Evidence of a valid registration to dispense or administer controlled substances in schedules II through V.
- Proof of compliance with the Federal Food, Drug, and Cosmetic Act, including documentation and agreements from the drug manufacturer or sponsor.
- Evidence that they can treat eligible patients under the laws of the state where treatment happens.
- Proof of relevant training, credentials, or experience.
- A description of where the drug will be stored and administered.
- Any other information the Attorney General needs to prevent diversion.
The amendment also requires the Attorney General to provide an electronic application process and set specific timelines for approving applications or issuing orders to show cause. It further directs the Attorney General to create rules regarding delivery, storage, security, record-keeping, and the renewal or revocation of these registrations.
