What this amendment would do

SA 5938, submitted by Ms. Hirono, aims to add a new section to bill S. 4784 regarding the exclusion of members of the armed forces from assignments based on gender.

The purpose of this amendment is to:

  • Prohibit the exclusion of members of the Space Force, Air Force, Marine Corps, Navy, or Army from any assignment, career field, or occupational specialty based on their gender.

  • Require an annual report from the Secretary of Defense to the House and Senate Committees on Armed Services. This report must include:

    • Details on changes to occupational standards, such as physical requirements, and how they predict performance of regular duties.
    • The number of service members who were separated or involuntarily reclassified (excluding criminal or disciplinary reasons), broken down by gender and military occupational specialty, including the reasons why.

  • Repeal section 8225 of title 10, United States Code.
