What this amendment would do

SA 5924, submitted by Mrs. Shaheen, aims to add a section regarding the continuity of operations for the position of General Counsel of the Federal Labor Relations Authority to bill S. 4784.

The amendment intends to change Section 7104(f) of title 5, United States Code by adding the following:

  • If the General Counsel dies, resigns, is removed, or cannot perform their duties, and there is no Acting General Counsel, the Deputy General Counsel will temporarily perform those duties.

  • This temporary arrangement lasts until a General Counsel or Acting General Counsel takes office.

  • The person serving in this capacity will have all authorities vested in the General Counsel.

  • These rules apply if both the General Counsel and Acting General Counsel offices are vacant on the date the paragraph is enacted.
