What this amendment would do
This amendment is called the Eliminate PRC Organized Crime Act. It aims to add a new section to the Foreign Assistance Act of 1961.
The main purpose of the amendment is to create a program that lets the Secretary of State help law enforcement agencies in Latin America and the Caribbean. This help is meant to build their capacity to collect information on, disrupt, and prosecute transnational criminal organizations linked to the People's Republic of China.
The amendment specifically allows for the following additions and actions:
- Assistance Programs: The Secretary of State can provide consultations, training, technical assistance, and vetting support to foreign law enforcement agencies. This includes help with financial investigations, digital forensics, and tracking money laundering.
- Coordination: The help must be coordinated with the Attorney General and, when appropriate, the Director of National Intelligence.
- National Interest Exceptions: The Secretary of State can still provide this assistance to a country that failed counternarcotics obligations if it is determined to be in the national interest of the United States, provided Congress is notified 15 days in advance.
- Reporting Requirements: The Director of National Intelligence and the Secretary of State must submit a report to appropriate congressional committees not later than one year after enactment detailing the assistance provided, known organized criminal activity, and PRC involvement.
