What this amendment would do

This amendment, submitted by Mr. Merkley, is called the Protecting U.S. Fishers from Illegal Foreign Flags Act of 2026. It aims to add a new section to the bill regarding the protection of U.S. fishers from illegal foreign flags.

The amendment seeks to change the High Seas Driftnet Fishing Moratorium Protection Act in the following ways:

  • It adds a provision regarding nations that allow vessels to operate under their laws without confirming a genuine link between the nation and the people or entities that have beneficial ownership and control of the vessel, resulting in a failure to exercise flag state responsibilities.

  • It requires the Secretary to amend the definition of illegal, unreported, or unregulated fishing within 90 days after the act is enacted to be consistent with section 3532(6) of the Maritime SAFE Act.
